1. Conclusion of Contract

The presentation of goods in the online store does not constitute a legally binding offer, but only a non-binding online catalogue. Goods can be ordered by using the shopping cart. You can place the selected product in the cart by clicking the “add to cart” button. By clicking the cart icon in the top right corner, you can view the products placed in the cart, modify their quantity, and remove them.

To complete the purchase, click the “continue to checkout” button. You can place your order as a guest user, but during the order process you also have the option to register an account or log in to an existing account.

Before finalising the order, you can check the checkout page for any incorrect order details and correct them if necessary. Finally, by clicking the “order” button, you submit your order for the products placed in the cart.

After receiving your order, you will immediately receive an order confirmation. This confirmation does not constitute our acceptance of the contract. The order is considered accepted when we send confirmation by email with the final invoice in the case of card payment. In the case of payment by bank transfer, the order is considered accepted when the final invoice is issued after the bank transfer has been completed based on the payment request.

2. Information on Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period expires after 14 days from the day on which you, or a third party indicated by you other than the carrier, takes delivery of the product.

If you wish to exercise your right of withdrawal, you must send us a clear statement of your decision to withdraw, for example by email, to info@boodabike.com. Please identify the order and the product or products concerned so that we can process the request. You do not need to provide a reason. You exercise your right of withdrawal within the deadline if you send your withdrawal statement before the expiry of the period stated above.

If you withdraw from this contract, we will reimburse payments received from you for the returned goods, including the cost of our least expensive standard delivery option, without undue delay and no later than 14 days from the date on which we receive your withdrawal statement. Additional delivery costs resulting from your choice of a more expensive delivery method are not reimbursed. The refund will be made using the same payment method used for the original transaction unless you expressly agree otherwise. We may withhold the refund until we receive the product back or you provide evidence that you sent it back, whichever occurs first.

You must return or hand over the product to us or to the instructed logistics provider without undue delay, but no later than 14 days from the date on which you communicated your withdrawal statement. The deadline is met if you send back the product before the 14-day period expires. Contact Booda Bike before shipping so that we can provide the applicable return address and instructions.

The cost of returning the product is borne by the customer.

You are only liable for any decrease in the value of the product if that decrease results from use exceeding what is necessary to establish the nature, characteristics, and functioning of the product.

3. Exclusion / Expiry of the Right of Withdrawal

The right of withdrawal related to the contract cannot be exercised in the case of a non-prefabricated product that was made on the basis of the consumer’s instructions or at the consumer’s express request, or in the case of a product clearly personalised for the consumer, perishable products or products that retain their quality only for a short period, or sealed products that cannot be returned after opening following delivery for health protection or hygiene reasons.

4. Delivery

We undertake delivery of goods not only within the territory of the European Union. Except for complete bicycles, delivery is usually carried out by Packeta or UPS. Complete bicycles are delivered by FedEx, Hungarian Post Service (MPL), or another delivery service provider.

We are only able to sell our goods in retail quantities and only to end users.

5. Warranty Rights

If the delivered product has a visible material or manufacturing defect, including damage that occurred during transport, please notify us of the defect without delay after discovering it, but no later than 14 days from the date of discovery, by email to info@boodabike.com or to the carrier’s representative upon receipt of the goods.

Please note, however, that you may no longer enforce your statutory warranty rights after the two-year limitation period counted from the performance of the contract.

Based on your statutory warranty rights, you may, at your choice, request repair or replacement, unless fulfilling the chosen warranty right is impossible, or would result in disproportionate additional costs for the business compared with fulfilling another warranty claim.

If you did not or could not request repair or replacement, you may request a proportionate reduction of the consideration, or you may repair the defect yourself or have it repaired by someone else at the expense of the business, or, as a last resort, withdraw from the contract. You are not entitled to withdraw from the contract in the case of an insignificant defect.

You may switch from your chosen statutory warranty right to another one, but you bear the cost of switching, unless the switch was justified or caused by the business.

Within one year from performance, the only condition for enforcing your statutory warranty claim is to notify us of the defect. After one year from performance, however, you must prove that the defect you discovered already existed at the time of performance.

In the case of a defect in the goods, you may, at your choice, enforce either your statutory warranty rights specified above or a product warranty claim. As a product warranty claim, you may only request repair or replacement of the defective product.

A product is defective if it does not meet the quality requirements in force at the time it was placed on the market, or if it does not have the characteristics stated in the description provided by the manufacturer.

You may enforce your product warranty claim within two years from the date on which the product was placed on the market by the manufacturer. You may enforce your product warranty claim only against the manufacturer or distributor of the movable item. When enforcing a product warranty claim, you must prove the defect of the product.

The manufacturer or distributor is released from its product warranty obligation only if it can prove that:

  • the product was not manufactured or placed on the market in the course of its business activity; or
  • the defect could not have been recognised according to the state of science and technology at the time the product was placed on the market; or
  • the defect of the product results from the application of a law or mandatory authority regulation.

Please note that you may not enforce a statutory warranty claim and a product warranty claim at the same time, in parallel, for the same defect. However, if your product warranty claim is successfully enforced, you may enforce your statutory warranty claim against the manufacturer for the replaced product or repaired part.

Definition of Consumer and Scope of Persons Entitled to Withdrawal

The right of withdrawal described above applies only to customers who qualify as consumers under the Civil Code and the relevant government decree. A consumer is a natural person acting outside the scope of their profession, independent occupation, or business activity.

Accordingly, the right of withdrawal may not be exercised by non-natural persons, such as companies, associations, or foundations, or by natural persons who purchase the product within the scope of their profession, sole trader activity, or business activity, for example by requesting an invoice with a tax number.

5/A. Mandatory Commercial Guarantee

The Service Provider is subject to a commercial guarantee obligation for its products under the Civil Code and Government Decree 151/2003 (IX. 22), provided that the customer qualifies as a consumer under the applicable laws.

The duration of the commercial guarantee depends on the sale price of the product as follows:

  • 1 year commercial guarantee for a sale price reaching HUF 10,000 but not exceeding HUF 100,000.
  • 2 years commercial guarantee for a sale price exceeding HUF 100,000 but not exceeding HUF 250,000.
  • 3 years commercial guarantee for a sale price exceeding HUF 250,000.

Start of the commercial guarantee period: The commercial guarantee period begins when the product is handed over to the consumer, or, if commissioning is carried out by the Service Provider or its agent, on the date of commissioning.

Rights arising from the commercial guarantee: Based on a commercial guarantee claim, the consumer may, at their choice, request repair or replacement, unless fulfilling the chosen guarantee claim is impossible, or would result in disproportionate additional costs for the Service Provider compared with fulfilling another guarantee claim.

If the Service Provider has not undertaken repair or replacement, or cannot fulfil this obligation within the appropriate deadline, the consumer may request a proportionate reduction of the consideration, or withdraw from the contract. Withdrawal is not available in the case of an insignificant defect.

Exceptions and release from liability: The Service Provider is released from its commercial guarantee obligation only if it proves that the cause of the defect arose after performance, for example due to improper use, mechanical damage, improper storage, or lack of maintenance.

Commercial guarantee certificate: The Service Provider provides the commercial guarantee certificate to the consumer electronically or in paper form packaged with the product, no later than the day following the handover or commissioning of the product.

6. Shipping Costs

The Service Provider delivers the ordered products by dividing them into categories and taking the destination country into account. The amount of the shipping fee varies depending on the size of the package and the delivery address.

6/A. Definition of Shipping Categories

Based on their size and weight, products can be classified into the following three logistics categories:

Small shipping category, general products: Smaller accessories and parts that can be handled as standard parcels.

Medium shipping category, wheels and larger products: Wheelsets, framesets, and other products that are larger than average but not oversized.

Large shipping category, bicycles and large products: Complete bicycles and other large shipments requiring special handling.

6/B. Country-Specific Pricing

Shipping fees vary by country. The current fees are calculated and displayed by the system during the checkout process after the delivery address has been entered.

6/C. Special Provisions for Delivery Outside the EU

In the case of shipping complete bicycles to countries outside the European Union, the Service Provider reserves the right to dispatch the product in two separate package units or boxes. This may be done to ensure safe shipping conditions and to comply with international logistics rules.

7. Payment

Payment by bank card:

During the order process, you can pay immediately by entering your bank card details. Our online payment terminal provider is Stripe (www.stripe.com). After the order is placed, neither party stores your bank card details, and under no circumstances can we charge your card after the purchase.

Payment by advance bank transfer:

During the order process, you also have the option to choose payment by bank transfer. In this case, when finalising the order, you will automatically receive a payment request prepared by us with the exact transfer details related to the order. Always include your order ID or invoice ID in the payment reference so that the payment can be clearly identified.

8. Prices

Our prices are stated in Hungarian forints and include VAT required by law, meaning they are gross prices. We make every effort to ensure that the prices in our online store are accurate. However, if incorrect prices are displayed despite this, we are not obliged to sell the goods at the incorrect price.

In such a case, we may offer the product to you at the correct price, and you are entitled to withdraw from the contract as specified in Section 2 above. A price is considered incorrect in particular, among others, if it is obviously incorrect or disproportionate.

9. Retention of Title

The goods remain our property until the full amount has been paid.

10. Alternative Dispute Resolution / Online Dispute Resolution (ODR)

If you have any issue with a cross-border online purchase that you cannot resolve with us, you may submit your complaint to an approved dispute resolution body through the following platform: online dispute resolution, ODR, Online Dispute Resolution.

In Hungary, the Budapest Conciliation Board is also competent to act in cross-border legal disputes:

However, we are not obliged and do not intend to participate in dispute resolution proceedings before consumer conciliation boards.

11. International Orders Outside the EU

Import fees and taxes: In the case of orders placed for delivery outside the European Union, additional import fees, customs duties, and local taxes may be charged once the package arrives in the destination country. These charges are the responsibility of the recipient and are separate from the shipping cost paid at checkout.

Estimated costs: Unfortunately, we cannot provide an exact estimate of these charges, as they vary by country and by the value of the order. For more accurate information, we recommend contacting your local customs office to obtain information specific to your situation.

14. Complaint Handling

Possibility of contacting an authority: The consumer may submit a complaint to the consumer protection authority. Under Government Decree 387/2016 (XII. 2) on the designation of the consumer protection authority, the capital and county government offices, and the Pest County Government Office, act in public administrative authority matters.
